Nowadays, a modern, knowledge-based economy is the key to attaining and sustaining a competitive advantage. Thus, countries undertake various measures to foster development and acquisition of intellectual property and implementation of breakthrough technologies. These measures may include tax incentives. However,what is often forgotten is that tax systems may also discourage R&D activities and IP transfers, or simply remain neutral.

This book is a result of the international conference "Tax Aspects of Research and Development - Towards More Sustainable Development in the EU" organised by the Centre of Tax Documentation and Studies of the University of Łodź, Poland, on 16 December 2011.

This book is a result of the international conference "Tax Aspects of Research and Development - Towards More Sustainable Development in the EU" organised by the Centre of Tax Documentation and Studies of the University of Łodź, Poland, on 16 December 2011.

The idea behind the book is to provide an overview of the income tax aspects of R&D activities and IP transfers and licensing in the EU Member States. The authors aim to assess how tax measures may influence development and movement of IP between the EU Member States and how they relate to the rules on freedom of movement, state aid and competition.

Specific issues dealt with in thematic reports include R&D- and IP-related tax incentives applicable in selected EU Member States and state aid limitations thereof, tax measures posing restrictions to cross-border R&D activities and transfers of IP (e.g. exit taxes, CFC rules) as well as transfer pricing aspects of IP transfers. These specific issues are summarised in a general report, whereby some conclusions are drawn.

Przewodniczący Komisji do Spraw Doradztwa Podatkowego II kadencji. Autor ponad stu publikacji z zakresu prawa podatkowego i budżetowego. Członek Rad Programowych pism "Przegląd Podatkowy", "Prawo i Podatki" oraz "Kwartalnik Prawa Podatkowego".

Dr hab. Adam Zalasiński pracuje jako Senior Legal Officer w Wydziale Prawnym - Podatki bezpośrednie Komisji Europejskiej w Brukseli. Specjalizuje się̨ w międzynarodowym i europejskim prawie podatkowym, w szczególności orzecznictwie podatkowym TSUE. W KE pełni funkcję koordynatora spraw dotyczących przeciwdziałania unikaniu opodatkowania, kwestii prawnych związanych z umowami o unikaniu podwójnego opodatkowania oraz transgranicznego potrącania strat. Jest autorem ponad 100 publikacji naukowych, w tym ponad 30 opublikowanych w międzynarodowych periodykach oraz opracowaniach zbiorowych. Jest częstym sprawozdawcą na międzynarodowe kongresy naukowe. Był autorem lub współautorem następujących raportów: Raportu Generalnego na Kongres Fédération Internationale pour le Droit Européen (FIDE) w 2006 r, Raportów EU na Kongresy International Fiscal Association (IFA) w 2013, 2019 i 2023 r., Polskich Raportów Krajowych na Kongresy IFA w latach 2008, 2010, 2016, 2018 i 2022 oraz Kongresy European Association of Tax Law Professors (EATLP) w latach 2006 i 2009. Wykładał lub wykłada europejskie prawo podatkowe na studiach podyplomowych oferowanych przez Uniwersytety w Londynie (IALS), Wiedniu (WU), Lozannie oraz Oksfordzie, a także na kursach oferowanych przez International Tax Academy IBFD w Amsterdamie. Jest członkiem Permanent Scientific Committee IFA oraz koordynatorem ds. European Doctoral Tax Thesis Award przyznawanej wspólnie przez Komisję Europejską i European Association of Tax Law Professors (EATLP).
