    About the possibility of academic justification of changing the model of criminal liability
    The paper is an attempt to answer the question whether a criminal law reform, entailing a significant change of the existing legal order,is an academic problem and whether academic arguments could be used to justify the necessity of it. Seeking such arguments, we tend to draw on dogmatics or the theory of criminal law. We also attempt to justify the necessity of the reform on the grounds of criminal policy. An analysis of the academic character of such an approach requires us to distinguish between two aspects of the reform - the internal and external one. The former consists in formulating assumptions on which the future reform and the model created for it should be based. The latter aspect includes the creation of a consistent model, corresponding to the previously made assumptions. While it is not possible to verify the correctness of the assumptions on which the model of criminal liability is built using academic standards (just as one cannot academically justify the need for its change), academic criteria can be used to assess the internal logical consistency of the model's components.

    European Union's privileges and immunities in the territories of its Member States
    This article presents the issue of EU's privileges and immunities in the territories of its Member States. In particular, the article characterises the legal grounds for such immunities, the group of entities that enjoy them, their scope and area of application. The author points out that the legal grounds for EU's privileges and immunities result from many sources, among which one can mention instruments of primary legislation, such as the Protocol on the privileges and immunities, but also agreements concluded by the European Commission with regard to implementing its provisions in the given Member State, and secondary legislation. Another important source of immunities of the EU and its bodies is the agreements concerning their seats; this applies in particular to decentralised EU agencies. As a result of the multiple legal grounds for EU immunities, the entities that enjoy them and the scope of immunities might differ depending on the Member State.

    Legal provisions and legal norms as the object of Constitutional Court's review
    The Constitutional Court defines as the object of constitutional review a legal norm, which it understands as a general norm and an abstract one at the same time. The Court does not abandon the concepts that are well-rooted in the Polish legal culture, such as legal provision or normative act. With the Polish Constitutional Court's assumption that the object of the review of constitutionality is a legal norm, this court must carefully indicate how it recreates legal norms from the provisions of law and the substance of the recreated legal norms.
    The fact that the Court indicates a legal norm as the object of its review of constitutionality of the law also requires reflection whether indeed in those proceedings it is always a legal norm that is reviewed. In the cases when the CC reviews the procedure of issuing a normative act, the object of its review is not a legal norm or a legal provision, but the specific law-making steps.

    A court's power to change the legal classification of an act presented in the indictment (the issue of compatibility of procedural mechanisms)
    The aim of this paper is to show how a judge's power to change an act's legal classification (or lack of such a power) affects other components of a given model of criminal procedure. The lack, or existence, of this power of the court has a number of procedural consequences. Its existence is linked to a whole doctrine of sameness of the act as charged and as ascribed, and unchangeability of the object of trial. It is an element of the theory of the principle of accusatorial procedure and its influence on the limits of criminal trial. The court's inability to change the legal classification results in introducing the option of adjudicating on the basis of alternative charges and also with respect to the so-called lesser included offences. This subject is also linked to the general ability to change the scope of accusation: whether by changing the contents of the indictment or by going beyond the limits of the accusation in an incidental trial.

    The notion of a public officer in the Act on Financial Liability of Public Officers for Glaring Violations of Law
    The article contains reflections on the notion of a 'public officer' as defined in the Act of 20 January 2011 on Financial Liability of Public Officers for Glaring Violations of Law. Taking up this topic is justified, because whereas the act was assumed to address the growing public dissatisfaction with lack of any real financial liability of public officers for losses caused by their actions where these actions were glaring violations of the law, the final normative shape is disappointing, especially as far as the group of persons that are covered by the liability is concerned. Moreover, many objections have been raised with respect to the legislative technique used, which led to a number of doubts relating to the application of the act. In particular, many doubts have been caused by the unclear formulation of the statutory definition of the notion of a 'public officer' and the fact that its wording significantly differed from that using in the bill. The article refers to those discrepancies and attempts to identify the potential ways of interpreting the aforementioned definition, identifying the practical consequences of each interpretation. The reflections end with proposals of desirable legislative amendments.

    Investment arbitration in the Transatlantic Trade and Investment Partnership
    If concluded, the Transatlantic Trade and Investment Partnership (TTIP)will constitute one of the most significant developments of the decade in international economic law. The treaty will have a major impact on the business and competition environment in the UE and the US and, even more importantly, as we are witnessing a gradual shift of power in global economics, it will shape the debate on the future of trade and investments relations. The latter is particularly interesting from the legal standpoint, as TTIP creates an opportunity for seting a regulatory benchmark in investment arbitration for third states. This calls for asking two sets of questions. Firstly, one should critically asses proposed modifications of the arbitration mechanism. Secondly, even if these changes do no address all the concerns recently voiced, one needs to analyse the consequences of removing arbitration from TTIP. Most importantly, would we thus deprive ourselves of the possibility of influencing the regulation in question, which nevertheless will be binding upon us?

    Legal position of decision-making bodies and officers of the Garda Síochána na hÉireann
    What is unique about the Irish police is the legal status of its decision-making bodies and officers, which results not only from institutional regulations,but also from tradition and historical accounts. The Garda Síochána na hÉireann is the name of a nationwide police service, which is in charge of enforcing laws and protecting order and public safety. The service was established in 1925 as a result of merger of the Dublin Metropolitan Police and the Royal Irish Constabulary. Its structure and tasks were based on the UK model, while the legal position of officers on the institutionalised system of common law. Further analysis concerns the applicable normative instruments regulating the activities and scope of powers of executive bodies and officers of the Irish police, as well as the legal principles that shape the mutual relationships between the commissioner of the Garda Síochána and the Minister for Justice and Equality.

    The notion of 'tryb' [mode] in the Polish Code of Civil Procedure
    The author, using example of the Polish words 'tryb' [mode] and 'tryb postępowania' [mode of proceedings], points out the unfavourable effects of the legislative manoeuvre consisting in using in the Polish Code of Civil Procedure the words and expressions that derive from the general language, where they have many meanings. Analysing examples of expressions used by the legislator and by legal scholars, the author comes to conclusion that this results in the enactment of legislative instruments which can be understood in various ways, giving grounds for judicial interpretation of the law. This judicial interpretation encroaches upon the sphere of competence reserved only for the legislative power. Crossing the borders of the tripartite division of power as well as the vagueness of those expressions undermine the authority of courts and the authority of the state. In his search for an instrument that would assure strengthening of the authority of the judiciary, in particular of the dignity of the court, the author points at the 'linguistic clarity of the message', as the point of departure for deliberations about the certainty of legal expressions in the Polish future Code of Civil Procedure and about the clarity of case law.
