    The Polish language as a communication tool of the legislator and a lawyer
    This article is an address delivered at a meeting of the Committee on Legal Sciences of the Polish Academy of Sciences held on 29 September 2016, which was devoted to the Polish language as a tool for communication between the legislator and lawyers, and the general public. It presents the origin and essence of notions of the Polish language as a language of legal norms and a legal language, meaning the language of description and interpretation of the law, the language of case law and law application, and - these days - also of legal literature. The main theme is the quality of the language of the law and the legal language from the point of view of its understandability, clarity, precision and adherence to the principles of the Polish language. It also presents the main reasons why, as is often the case, both the language of the law and the language used to describe and apply the law fail to communicate clearly the meaning and message of a legal norm. This is so for a few reasons: unjustified change of the meaning of a given notion or term; incorrectness or violations of the rules of Polish grammar and other principles of linguistic correctness; erroneous or arbitraty translations and adaptations of international law into national law, as well as carelessly made legal transplants; the use of professionalisms that are unclear and unknown in the standard of the Polish language and law (narrowly understood professional terminology) and all other signs of lack of care in legislation, where principles of the ethics of language use are violated. These errors bring on a plethora of undesirable phenomena, including,firstly, a situation of lack of clarity whether the substance of a legal norm that the legislator wanted to convey is what was eventually conveyed,secondly, what legal interpretation should be correct, what interpretation is possible and how many different interpretations can be made on the basis of an imprecise statement. The author also takes up the topic of how to prevent such unwanted situations and to what extent such prevention can be successful. She also touches on a few secondary topics, including legal regulation (Act on the Polish Language), the level of the language of politics and its influence on public life, the meaning of hate speech, as well as the question of protection for languages of national minorities, dialects, and disappearing languages.

    The notion of a system of law in the dogmatics of the law of criminal procedure
    This text analyses the notion of a ‚system of law’ in the dogmatics of the law of criminal procedure. It presents views recognising the law of criminal procedure as a system of law and those questioning the possibility of treating the law of criminal procedure as a system. The law of criminal procedure is understood in an ontological sense, as a distributive set. Adopting a different research perspective, the author treats the law of criminal procedure as a collective set, which constitutes part of the national law. He asserts that in the law of criminal procedure there are relationships between the procedural norms of formal and substantive character that allow treating this system as a mixed one, i.e. one having a dynamic-static nature. The system of law of criminal procedure is not an ontological, but an epistemological one. It constitutes an instrument which allows creative prioritising of the procedural norms included in many legal acts.

    The concept of judicial deference in competition law
    The article presents the concept of judicial deference in the context of competition law - the area of law where economic expertise is important and where administrative authorities play a major role. It argues that the concept of judicial deference is not about imposing limits on the scope of judicial review; it is only after courts have exercised effective review that they may defer to the conclusion reached by the administrative authority, even if alternative one exists. At the same time,the article posits that judicial deference may be considered permissible only if conditions related to fairness of administrative proceedings, impartiality of the administrative decision-maker and the latter’s expertise are met. The article analyses the areas of competition authorities' findings where the concept of judicial deference may be of potential relevance. The following areas are covered: interpreting the law, factual findings, complex economic assessment, fining, and discretionary choices. The article also examines the systems of enforcement of competition law in the EU, Poland and in the US, and discusses whether the conditions which make courts' deferential approach permissible are present in these systems. The author concludes that the areas of complex economic assessment and fining are particularly fit for the deferential style of review. When it comes to judicial deference conditions,they are found to be present in the US (judicial review of Federal Trade Commission's decisions) and to some extent in the EU. In this vein, the article calls for improvements regarding the fairness, impartiality and expert character of the enforcement of competition law in Poland and in the EU.

    Limitation of claims for compensation for overbooking,cancellation or delay of a flight
    There is a problem in determining the period of limitation of claims for compensation for overbooking, cancellation or delay of a flight. Regulation 261/2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights,and repealing Regulation (EEC) No. 295/91 does not contain any information in this regard. However, one should consider whether international law does not give us an easy answer. According to the ECJ, national law should apply in this case. Is this a good solution? This article attempts to find, in the Polish law, the provisions that would apply to limitation periods for claims arising from Regulation 261/2004.

    Interest on late tax refunds in the Polish law
    This paper discusses the issues of payment of interest after failure to keep the statutory deadline for tax refund in the Polish tax law. The intent is to show that the taxpayer or another entity designated by the legislator should have the right to apply to the tax authority requesting the payment of interest for late refunds. In this case, such a right must arise from an express provision of the tax law.
    The Polish legislator has not regulated the issues of payment of default interest for late tax refund in a comprehensive manner. It is also unjustified to differentiate the legal position of payers of the various taxes, involving the setting of interest for late tax refund for certain taxes. The current casuistry in this regard should be replaced by a single regulation establishing the general interest for late refund of any tax.

    Begging in the perspective of human rights
    The Code of Petty Offences in Art. 58(1) specifies that begging in a public place, when done by people capable of working or having means of subsistence,constitutes an offence. The purpose of the article is to assess the rationality of this regulation and its compatibility with the Constitution of the Republic of Poland. For the achievement of this goal, the article elaborates on five issues. Firstly,the essence of begging, based on the results of research in the social sciences. Secondly, the position of this provision among other norms of the Polish criminal law aimed at counteracting begging. Thirdly, a historical justification for this provision. Fourthly, the practice of its application. Lastly, its compatibility with constitutional and international standards for the protection of human rights. The conclusions indicate that this provision is unreasonable and incompatible with the Polish Constitution.

    Permissibility of counter-evidence of lack of danger (selected problems of the abstract-specific danger to legal goods)
    This paper is a brief theoretical sketch of the so-called aptitude offences (Eignungsdelikte) from the theoretical perspective of counter-evidence of lack of danger and the doctrine of legal goods. The issues the article touches upon concern the problem of justifying criminal liability for an inchoate threat to a legal good. In this regard, it proposes the notions of potential danger in the ontological and normative senses, which notions serve as tools for analysing the justification of treating some behaviours as offences. As far as aptitude offences are concerned, the notions of suitability as a possibility and as a state are introduced by means of an ontological-semantic analysis. Their emergence corresponds to a different evaluation of threat to the legal good, which is a feature of criminal conduct. It introduces a rebuttable presumption of danger as well, which determines the admissibility of counter-evidence of lack of danger. In criminal procedure,at the stage of preparatory proceedings, the counter-evidence need not be taken in each case. At the stage of judicial proceedings, the accused only has to make lack of danger plausible, effectively shifting the burdens of proof onto the prosecution.
