    On the need for critical constitutional law studies
    The article touches upon the subject of critical legal studies in the context of constitutional law. The authors illustrate briefly the beginnings of critical theories in social science (in particular the theories of Max Horkheimer) and also the basic tenets of CLS. The 'crits' emphasize in particular that many aspects of law, such as legal reasoning, judicial proceedings, rules of argumentation, lawyer's education, etc. are,contrary to what science postulates, as they are determined by particular ideologies and interests of various social groups. CLS denies the positivist statement that there is an 'objective' interpretation of law or 'objective' subject of the study, such as the constitution. In the context of recent political events in Poland, the representatives of constitutional law and, in particular, the judges of Poland's Constitutional Tribunal,must realize that the claims of 'objective' meaning of the law or apolitical constitutional courts are ineffective, and that they should use CLS as a tool for demystifying the arguments used by political forces that intend to introduce major changes in the constitutional status quo.

    The notion of 'legal impossibilism' and the political nature of the law and legal science
    The main aim of this article is a critical analysis of the notion of 'legal impossibilism', which in recent years entered the Polish political and legal jargon. Seemingly, it is to serve to overcome certain alleged impossibilities in the process of enacting and applying laws. But this author believes that in reality the argument of 'legal impossibilism' is a synonym of dangerous instrumentalisation of the law for the purposes of politics of the day.
    In the second part of the article the author attempts to answer the question whether the philosophy of Carl Schmitt can justify such an understanding of 'legal impossibilism'. His answer is negative. The author suggests a certain new interpretation of Schmitt's thought as a lawyer,which interpretation differs from those popular in the contemporary political philosophy. In the author's view, Schmitt's aim is not a permanent state of emergency, but a normal functioning of the legal order. In this sense, Schmitt does not treat law and politics as opposites, but rather combines them.

    The form of a testament from the perspective of recodification of the Polish inheritance law. Time for a revolution?
    Issues regarding to the form of a testament are one of those areas of the law of inheritance which are not discussed too often. Meanwhile,the changes that took place in the society in recent decades require confronting the existing regulations with the needs of the society. With this in mind, the author presents the current Polish law solutions and explores global trends in the development of law in this field. He considers whether the Polish regulations are adequate for the present day requirements and proposes new solutions in this area. He concludes that legislative amendments in Poland are necessary.

    Fixing and charging the so-called rainwater fees (de lege lata and de lege ferenda remarks)
    The present paper concentrates on the legal aspects of possibility for municipal authorities to charge fees for discharging rainwater and snowmelt. In their analysis of the research problem, the authors present both the Act of 7 June 2001 on the Collective Water Supply and Discharge of Wastewater and the Regulation of the Minister of Construction of the 28 June 2006 on determining tariffs, model of the application form for tariffs confirmation and settlement terms for the collective water supply and discharge of wastewater, pointing out the lack of consistency of provisions included in these two legal instruments. In the article, special emphasis is on the case law of administrative courts relating to the problem. On the basis of an analysis of this case law, the authors propose a possible way to interpret the controversial legislation. The article ends with the de lege ferenda postulates, the introduction of which should help eliminate doubts related to the possibility for municipal authorities to charge fees for discharging rainwater and snowmelt.

    Codification of non-contentious administrative procedure in France
    The majority of norms of French non-contentious administrative procedure emerged from the case law of the administrative courts, which has been partly organized during the last 40 years. Code des relations entre le public et l’administration, which entered into force on 1 January 2016, can be regarded as a conclusion of this process. The purpose of the codification is to facilitate the individual's access to the administration by simplifying procedures and by harmonizing the existing normative provisions, as well as improving the accessibility and readability of the legal text. The Code can be described as systematising codification (codification a droit constant) and does not fundamentally change the non-contentious administrative procedure. The vast majority of the provisions of the new Code are a result of the incorporation of the contents of the laws adopted in recent years. What is new - at the legislative level - is the provisions regarding revocation of unilateral administrative acts, as well as regulations concerning public participation in non-contentious administrative proceedings.

    Legal nature of claims for compensation under Regulation (EC) 261/2004
    In aviation law, there is a problem in determining the period of limitation for claims for compensation for overbooking, cancellation or delay of a flight. Regulation 261/2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295/91 does not contain any information in this regard. However, one should consider whether international law does not give us an easy answer. According to the CJEU national law applies in this case. Is this a good solution? This article attempts to answer the question of the limitation period for claims arising under Regulation 261/2004. The aim is also to determine the relationship between the international and EU systems of the protection of air passenger rights.

    Res Publica of diversified law. Remarks about the legal order of the Polish Republic in 16th-18th c.
    The legal order of the old Polish Republic in the period from the 16th c. to the 18th c. was diversified, mainly in systemic terms. It corresponded, though the reasons for its creation varied, to the ethnic, cultural and religious diversity of the state. Defining the legal order of the old Polish Republic in the form of a specific systematics, based on various criteria of division of the then existing legal systems, while showing the existence of the order in the context of a certain hierarchy, reflects a certain specific case of operation of a legal order which,despite certain inconvenience, did not lead to extraordinary collisions however. Owing to this, our reflections have much more universal application to similar situations that exist in the contemporary world.

    Legal research in contests of the National Science Centre
    The text deals with the issue of the model of financing legal research in Poland, within the framework of the programmes of the National Science Centre,as well as its practical operation. The Centre is a government agency responsible for administering public funds on research in all disciplines in Poland. Legal research has, however, a very peculiar nature compared to the general design of the grant programmes carried out at the Centre. This applies, firstly, to the premises and boundaries of legal analyses as basic research (the only type of research funded by the Centre), defined as 'experimental or theoretical endeavours undertaken to gain new knowledge of the foundations of phenomena and observable facts, without any direct commercial use'. Secondly, the text indicates also specific trends and deficits in the methodological design of the research and addresses the question whether the general assumptions adopted by the Centre promote universally or locally oriented topics and methods of research. Lastly, it discusses the way in which research is conceptualised, along with identification of associated risks, and indicates typical shortcomings found in the proposals filed to the Centre.

    Clean criminal record requirements in the Polish legal system (an outline)
    This article outlines the issues concerning the requirements of clean criminal record in the Polish legal system, which are basic requirements for certain professions or functions and in certain projects. It discusses the functioning of the National Criminal Register, which provides information on criminal history of individuals and legal entities; in particular issues related to the query for information on this subject, granting it and appealing against it. The article presents a typology of provisions introducing the requirements of clean criminal record and the problems emerging in this field, especially due to the ambiguity of those provisions and their wording. The reflections end with proposals addressed to the legislature and to persons whose professions involve dealing with criminal history information. The main finding emerging from this article is that doubts as to whether the requirements of clean criminal record are met in a particular case should be settled in favor of the individual/entity concerned.
