    Measuring the readability of Polish legal texts
    The article presents the problems connected with evaluating the readability of a legal text. The construction of selected measures of readability of general language texts is discussed, with special emphasis on measures tailored to meet the particularities of Polish. It is indicated that those measures, when applied to assessing a legal text, do not take into account the difficulties resulting from the legislator's use of means outside the general language norm, which are only found in the legal language. The justification for using them in legal texts is the empirically confirmed regularity that a linguistically difficult legal text causes interpretation difficulties. Apart from the 'general linguistic' readability measures, a measure specific to the legal language is presented,one connected with the existence of references. It is shown that the more unclear and difficult to understand the legal text is in general language terms, the more this text is saturated with references.
    The problems of differentiating the readability of a legal text depending on the type of reader (general, specialist) are discussed. The writer emphasises the need for the legislator to use analytical readability indices that take into account the particularities of the legal language,as well as the need to provide the general reader with knowledge on the law and the legal language.

    Democratism of the New Deal against the constitutional judiciary
    The counter-majoritarian difficulty is one of the most important dilemmas of contemporary American constitutional law and political studies. There is no coincidence in the fact that presidents perceived as the most democratic ones (i.e. favoring more direct democracy): Thomas Jefferson, Andrew Jackson or Abraham Lincoln, were at times conflicted with judiciary. The most famous and important case of such confrontation was the opposition between the democratic doctrine of Franklin Delano Roosevelt and the Supreme Court during the Lochner era, in the 1930s. Because the New Deal was based on the state acting as the administrator and promoter of social and economic life, it was necessary, claimed the New Dealers, to vest the executive branch with a broader scope of powers. The authority to reform the political and legal systems was allegedly based on the will of the people - the outcome of the democratic elections and the expectations of the nation. However,many of the New Deal's provisions contradicted the traditional understanding of the Constitution, invoked by the Supreme Court during many of the judicial review cases. Thus the rule of law and separation of powers doctrine were confronted with the democratic aspects of the New Deal. The outcome of this encounter was decisive for the future shape of the political system of the United States and position of the Supreme Court in the system of government.

    Practical positivism, theoretical positivism,living positivism
    The article considers a question about the current condition of legal positivism as one of the main traditional ways of understanding the law. For this sake, a differentiation between theoretical positivism (as the scientific school or the paradigm of legal sciences) and practical positivism (as the picture of law practically accepted by the majority of contemporary legal professionals) is proposed. Within this framework,the paper argues that positivism is still a dominant component of the practical world-view of legal professionals - the fact which is the main reason for this school's constant significance. Subsequently,practical positivism is interpreted within the framework of the sociology of knowledge - using such concepts as the life-world or the form of life - which allows to expose its nature as the unconscious and unquestionably accepted basis of legal thinking. The next part analyses the substance of contemporary positivism, including explicating its links with the rule of law. Finally, the last section tackles the question about the olitical and moral ideal which lie at the root of legal positivism. Highlighting such an ideal appears to be particularly relevant in the context of the current political disputes in Poland, in which legal positivism, together with the ideas of legalism and the rule of law, are from time to time accused of sabotaging political transformation.

    Public administration authority being bound by its own decision and the possibility of its auto-verification
    A public administration authority is bound by a decision it has issued from the time of its service or announcement, unless the Code of Administrative Procedure provides otherwise. The author analyses the powers of public administration authorities to auto-verify their own decisions, which powers are specified in the Code and in the Law on Proceedings before Administrative Courts. These powers include not only the right to directly modify or quash decisions, but also the right of the issuing authority to supplement its own decision, rectify any obvious errors in it or to provide an interpretation of the decision. In literature and case law major doubts are expressed about the scope of application of the methods of auto-verification of decisions analysed here. The author draws attention to them, while rejecting the term 'quashability of a decision' used by some legal scholars, which term is not adequate as reference to the administrative authority's ability to rectify its own decisions. The authority's power to rectify errors or mistakes in the decisions it has issued is a faster way of eliminating such defects than leaving these changes only in the hands of higher-ranking authorities. It is also a better and less expensive method of removing such defects than doing so as a result of a final judgment of an administrative court granting an appeal.

    Statutes of a trade union as a source of labour law
    Statutes are the fundamental internal instrument of organization of every trade union. Taking into consideration the range of issues regulated in this instrument,it can be said that it plays an even more significant role than statutes (articles of association) of most other legal persons. Therefore, considerations relating to different aspects of trade union statutes are extremely important and of great significance.
    Among the various planes of research, this paper focuses on the issue of trade union statutes as a source of labour law in the light of Art. 9 of the Labour Code. The author demonstrates, firstly, that it is possible to include in statutes some provisions which are norms of labour law and, secondly, analyses what mutual rights and obligations between a trade union (as the employer) and its employees can be regulated in this instrument.
    In addition to those reflections, the article also presents the theory which explains that trade union's statutes have a mixed obligational-normative legal character.

    A sequence of imprisonment and restriction of liberty as a reaction to the committed offence (Art. 37b of the Criminal Code)
    This paper concerns the mechanism of judicial imposition of a punishment in the form of a sequence of two punishments (imprisonment and restriction of liberty) on the basis of Art. 37b of the Criminal Code. The author defines the nature of this mechanism and discusses the permissibility of imposing a fine in addition to the sequence of punishments, the possibility of conditional suspension of serving the punishment of imprisonment, the manner of resolving the concurrence of Art. 37b CC with provisions that constitute the basis for extraordinary mitigation/aggravation of punishment, as well as the manner of calculating the limitation period for serving the penalties imposed within the sequence or the period after which a sequence of punishments is erased.

    Social efficiency of administrative law (an outline of the conception)
    The article presents a theoretical conception of the social efficiency of administrative law. A statement is put forward that the 'aim' of administrative law should be selected human needs, while the 'result' of its operation should be satisfying these needs in the public perception. Thus understood, the link between results and aims is referred to as the social efficiency of administrative law. The presented perspective is an alternative to the classical theories of examining the efficiency of legal norms. It does not refer directly to the behavioural sphere,but the result of the law's operation in the area of satisfying universal human needs; the scope of these needs was based on the so-called A.H. Maslov's pyramid. The article also touches upon the problems of methodology of the social efficiency of administrative law and the related contentious issues. The focus on the social dimension of operation follows on from an appreciation of the important role played by administrative law in the public sphere.

    Right of defence and the possibility of punishing a party to tax proceedings with a penalty for breach of order
    This article discusses, from the point of view of the right of defence, and specifically in the context of the privilege against self-incrimination, the issue of punishing a party to tax proceedings that has not provided explanations or has not submitted evidence requested by the tax authority with a penalty for breach of order specified in the Tax Ordinance Act. The author also discusses the rights and duties of the counsel representing such a party, paying special attention to the importance of the counsel's duty of confidentiality and the role of the counsel. The analysis is based on literature and case law of administrative courts and of the European Court of Human Rights.
